This will be a historical moment, in India’s political arena. 𝐊𝐚𝐛𝐢𝐫 𝐒𝐢𝐝𝐝𝐢𝐪𝐮𝐢: You started election analysis programme on Doordarshan. As ‘The Pathfinder Of Doordarshan News’ what are the factors, according to you; that gives an edge to BJP-NDA over the I.N.D.I.A. group? 𝐍𝐞𝐞𝐥𝐚𝐦: The main factor is that there’s no collateral Opposition. The people of India can make out, that this opposition alliance has no issues or agenda. It will collapse like a house of cards. Although several political analysts are differing on forecasts for the 2024 Lok Sabha elections, but the 18th general elections in the country, will see 343 out of 543 seats go to Bharatiya Janata Party (BJP); singularly led by the incumbent Prime Minister Narendra Modi. So the people of India trust NDA more than the opposition parties, as they failed to provide a viable alternative leader, policies and agenda for common man. 𝐊𝐚𝐛𝐢𝐫 𝐒𝐢𝐝𝐝𝐢𝐪𝐮𝐢: The Exit Polls will be released after voting for the final phase ending on June 01 from 6 pm onwards. The final result will be declared on June 04. What can we factually predict? 𝐍𝐞𝐞𝐥𝐚𝐦: I have categorically stated that the BJP-led National Democratic Alliance (NDA) will form the Government. This is drawing a flak on me, but I can assertively say so, based on the ground level survey and interviews carried out by my teams. I also say so, because the incumbent BJP government at the Centre faces neither significant dissatisfaction nor a strong demand for an alternative government in the 2024 Lok Sabha elections. Infact the attacks by political parties were ‘personality oriented’, the actual issues confronting the common man were missing from the Opposition’s plank. I am certain that Narendra Modi led BJP is returning to power. They will get nearly the same numbers as in 2019 elections or slightly more. Narendra Modi is securing his third term, as Prime Minister of India. 𝐊𝐚𝐛𝐢𝐫 𝐒𝐢𝐝𝐝𝐢𝐪𝐮𝐢: Dr. Manmohan Singh, former P.M. has alleged that Mr. Modi has lowered PM office’s gravity with hateful words. What’s your opinion? 𝐍𝐞𝐞𝐥𝐚𝐦: See for Dr. Manmohan Singh to say so, only for Narendra Modi is a subjective statement. Infact the Congress campaign by Rahul Gandhi, Priyanka Gandhi Vadra, Mamta Banerjee, Kejriwal, Tapasvi and Lalu Yadav, were equally hateful and Narendra Modi was vitriolically and viciously attacked by I.N.D.I.A. group. The fact is that the public discourse has considerably deteriorated, so it can not be said for any one person alone. While there has been some discont and dissatisfaction within BJP, there is no widespread anger against it, and more importantly, with BJP’ chief leader, Narendra Modi himself, had no challenge from any quarters. 𝐊𝐚𝐛𝐢𝐫 𝐒𝐢𝐝𝐝𝐢𝐪𝐮𝐢: So ‘Abki Bar 400 Paar’ slogan of BJP will actualize? 𝐍𝐞𝐞𝐥𝐚𝐦: Ha ha ha … see BJP is a clever party! They gave this slogan of 400+ to create a euphoria amongst the voters. They know that they will get less than that, but they will form the government, so it’s OK. In politics, perception and projection plays a significant role. This would give the Opposition alliance 200 to 210 odd seats, presenting a formidable challenge to BJP in Parliament. So we need to see that BJP is getting 272+ majority mark. Politics and chatterwill continue. BJP currently holds less than 50 of the 240 seats in the East and South, which include states like Bihar, West Bengal, Assam, Odisha, Telangana, Andhra Pradesh, Tamil Nadu, and Kerala. The party’s strength comes from the North and West, where it has secured 260-270 out of 300 seats. Moreover BJP’s vote share and seats are rising in the South and East. Those doing commentaries will continue to do so. But I am most certain that NDA is returning to power. 𝐊𝐚𝐛𝐢𝐫 𝐒𝐢𝐝𝐝𝐢𝐢𝐪𝐮𝐢: What are the areas where the new government should focus on? 𝐍𝐞𝐞𝐥𝐚𝐦: The Narendra Modi government has to negotiate with the farmers. Haryana and Delhi repeatedly blocked farmers from entering Delhi. Repeated ‘Farm Agitations’, employment, FDI, hospitals, a robust foreign policy, economic resurgence, globalisation, women’s participation in political arena and security for women, are some areas that need much more attention. 𝐊𝐚𝐛𝐢𝐫 𝐒𝐢𝐝𝐝𝐢𝐪𝐮𝐢: So in retrospect which are the key issues that would secure a resounding return of Narendra Modi? Is Hindutva an important factor? 𝐍𝐞𝐞𝐥𝐚𝐦: I can most categorically state, that the inauguration of Ram Mandir in Ayodhya, scrapping Article 370 and 35A from Jammu and Kashmir and implementation of Uniform Civil Code by BJP-NDA government had a great impact on the voter’s psyche. Further to this, these were the key issues in BJP’s agenda, since it’s inception. It is Narendra Modi who has actualized the same. Further he’s got a powerful oratory skills and vision for the future. People connect with him. Ofcourse Hindutva is very much a vote catcher. Technology, Artificial Intelligence And Integration Of Criminal Justice System

By: Prof. Neelam Mahajan Singh In a democratic representational structure, the rights and duties of citizens requires careful consideration. It is imperative to prioritise ethical considerations while using Artificial Intelligence and modern technologies. As such the global digitization has intruded into the privacy of every single person! Recently Chief Justice of the Supreme Court of India, Justice Dr. Dhananjay Yashwant Chandrachud delivered the keynote address at, 20th D. P. Kohli Memorial Lecture on C.B.I.’s Raising Day.Justice Chandrachud said, “in the era of digital transformation, the interplay between law and technology can result in better crime detection and also ensure criminal justice reforms”. Technology has emerged as powerful force for justice delivering system. A cautionary note, from issues of jurisdiction and privacy to questions of accountability and transparency, the integration of technology into our criminal justice system, requires careful consideration of the ethical, legal, and societal implications at play. “In embracing the capabilities of technology, we reaffirm our commitment to the principles of fairness, equity, and accountability. By leveraging these tools responsibly and ethically, we ensure that the benefits of technological advancement reach all members of society, regardless of their background or circumstances. However, it is imperative to prioritise ethical considerations in the utilisation of these technologies,” said Justice Chandrachud. Clear guidelines have to be followed to safeguard and prevent misuse or abuse of ‘Artificial Intelligence’ and other advanced technologies, to safeguard privacy rights, and address biases that might inadvertently arise. Probe agencies, like C.B.I. N.I.A. E.D. state police etc. should keep up with radical changes in crime in a digitally connected world. The global nature of crime also necessitates extensive coordination and collaboration with counterparts abroad, which could slow down the investigative process.Multidisciplinary teams consisting of law enforcement officers and domain experts, including data analysts, should deal with such cases. “The CBI can be upgraded by reassessing the challenges of our changing times and by making structural reforms in CBI,” said Dr. Chandrachud. The C.B.I. has undergone significant reforms, at the centre of which is the setting up of the ‘Network for Evidence Tracing, Research, and Analysis’ (NETRA) Lab. NETRA represents a leap forward in investigation agencies’ ability to analyse electronic evidence, including mobile devices, cloud storage, and e-Discovery, plays a crucial role in expediting the investigation process and delivering justice swiftly. The new criminal laws, enacted recently by the Parliament encompasses substantive crime, procedures and evidence, that is a significant step towards modernising the justice system. Two points are flagged as main concerns related to digital transformation, i.e. the first being the risk of individual’s without Internet access or technological proficiency getting excluded. Thus, there is a pressing need to ensure that the benefits of digitisation are equitably distributed and that mechanisms are in place to address the digital divide. Secondly, particular attention ought to be paid to the digitalisation of foundational processes such as the filing of FIRs to streamline and trace back the sequence of events and enhance transparency from the very outset. Investigations should be synchronised with court procedures for effective and time-bound prosecutions. Given the complex nature of investigations undertaken by investigation agencies, the courts have a herculean task of de-complexification of the case and ensuring that the parameters of the law are followed to dispense justice. The challenges today and tomorrow require an institutional commitment; which requires dedicated finance to upgrade infrastructure, synergies between different wings of the criminal justice administration; and calibrated strategies to train all the personnel to understand the rapid changes in the environment. A multi-pronged approach has to be adopted to integrate technology with court procedures, in order to ensure that the severity of accusations, coupled with excessive delays in courts, ‘do not translate to a presumption of guilt’. A ‘virtual court model’ has recently been developed by the e- Committee of the Supreme Court of india. When implemented as a pilot project, it enabled simultaneous conversion of speech into text. A mobile application could be designed with predefined timelines corresponding to different stages of investigation or trial; it should include an alert system to notify relevant parties when approaching the deadlines. In homicide investigations, the forensic experts in U.S. utilised advanced DNA analysis techniques to match genetic material found at the crime scene with a suspect. ‘Artificial Intelligence’ stands out as a game-changer. An identification tool in U.S.A. has helped identify over 17,000 children, who had fallen victim to sex trafficking, resulting in a 63% reduction in the investigation time. In retrospect, it may be stated that, ‘Artificial Intelligence’ is not free of prejudice and biases. Because of the skewed data, ‘Artificial Intelligence’, may lead to community-based profiling of marginalised social groups as having committed more crimes. There is a need to maintain a delicate balance between ‘search and seizure powers, and individual privacy rights’ that stand at the cornerstone of a fair and just society. A petition that was recently filed in the Supreme Court highlighted the absence of well-defined legal frameworks governing the procedures for electronic device searches and seizures. The Supreme Court directed Union agencies to adhere to the 2020 ‘C. B.I. (Crime) Manual on Digital Evidence’ until formal guidelines are established. The ‘Citizens Democratic Charter’ needs actualisation. One single case of miscarriage of justice, can destroy a citizen’s life. A society that is disciplined with structural parameters of investigation procedures, ought to be done with utter caution for justice to the common man. We the people of India! भाजपा का एक भी मुस्लिम सांसद नहीं है। भाजपा द्वारा हाल ही में नागरिकता संशोधन अधिनियम (सीएए) का अनावरण, आगामी चुनावों में, विशेष रूप से पूर्वी और उत्तर-पूर्वी भारत में गेम-चेंजर साबित होने वाला है। अल्पसंख्यक मतदान व्यवहार पर नज़र रखी जाएगी, संभावित एकीकरण के साथ, राजनीतिक परिदृश्य को नया रूप दिया जाएगा। उदाहरण के लिए, पश्चिम बंगाल में यह अधिसूचना, ममता बनर्जी की तृणमूल कांग्रेस के लिए मुस्लिम समर्थन को प्रेरित कर सकती है। जैसा कि कहा गया है, इलेक्टोरल बॉन्ड का मामला एक ‘लिटमस टेस्ट’ होगा। जहां विपक्ष ने एक बार इलेक्टोरल बॉन्ड को दुर्जेय हथियार के रूप में पेश किया था भाजपा व कॉरपोरेट दिग्गजों के बीच ‘क्रोनी कैपिटलिज्म’ व लेन-देन के आरोप बड़े पैमाने पर हैं, जो राजनीतिक नैतिकता पर छाया डाल रहे हैं। जैसे-जैसे नागरिक सत्ता व विशेषाधिकारों के बीच गठजोड़ की जांच कर रहे हैं, ‘चुनावी बॉन्ड’ राजनीतिक ईमानदारी व जवाबदेही के स्पष्ट बैरोमीटर के रूप में सामने आ रहे हैं। प्रधानमंत्री नरेंद्र मोदी के शक्तिशाली वक्तृत्व कौशल व भविष्य के लिए दृष्टि ने विपक्ष के कथानक को धूमिल कर दिया है। भाजपा की कथित विभाजनकारी रणनीतियों, द्विध्रुवीय रुख व “मोहब्बत की दुकान” के बैनर तले समावेशिता की उसकी दलील पर विपक्ष का ध्यान एक सम्मोहक तर्क प्रस्तुत करता है। फिर भी, इन आख्यानों के प्रति जनता की भावना की नब्ज़ अनिश्चित बनी हुई है। राष्ट्रवाद पर भाजपा का ज़ोर, भारत के लिए उसके दूरदर्शी दृष्टिकोण के साथ प्रतिध्वनित होता है। समान नागरिक संहिता और एक राष्ट्र, एक चुनाव की अवधारणा जैसे प्रस्ताव इस दृष्टिकोण को समाहित करते हैं, सुव्यवस्थित शासन और सामाजिक सामंजस्य का वादा करते हैं। सारांशाार्थ इस वैचारिक टकराव के बीच तो मतदाता यह समझने में उलझे रहते हैं कि कौन सा दृष्टिकोण उनकी आकांक्षाओं व राष्ट्र के भविष्य के साथ अधिक निकटता से जुड़ा हुआ है। यह दु:खद है कि भारत की आज़ादी के सत्ततर वर्षों में, हम अपने नागरिकों को जीवन जीने की बुनियादी संरचना प्रदान करने में असफल रहे हैं। यह लोकतंत्र के जश्न का एक और अभ्यास मात्र है, क्योंकि नागरिक वोट डालने के अपने विकल्पों का आनंद लेते हैं। सच तो यह है कि हम भारत के हर नागरिक को सामाजिक, राजनीतिक और आर्थिक रूप से सशक्त बनाने में विफल रहे हैं। कुछ हाथों में धन का ‘संकेन्द्रण, क्रोनी पूंजीवाद’ की प्रतिध्वनि है, जो संसाधनों के समान वितरण की जीवन शक्ति को कम कर रहा है। भारत दुनिया का सबसे अधिक आबादी वाला देश बन गया है। आइए सुनिश्चित करें कि मतदाता भारत के भविष्य को ध्यान में रखते हुए अपना वोट डालें। अन्यथा 2024 का आम चुनाव, मात्र हर पांच सालों में होने वाली एक और घटना बन कर जाएगा। प्रो. नीलम महाजन सिंह (वरिष्ठ पत्रकार, लेखिका, दूरदर्शन व्यक्तित्व, मानवाधिकार संरक्षण

Sharma, academician, author of several books, i.e. Internationalisation of Education, Sixty Years Of University Grants Commission, The Windmills Of The Mind, Hindu College, Delhi — A People’s Movement etc. Several journalists and educators participated in this discussion. India and China are neighboring countries and their traditional relationships had many ups and downs. Although at present diplomatic relations between the two countries are at the lowest ebb. However there is no possibility of a war between India and China. The reason being, the increasing trade between two countries.  In 2023 trade between the two countries was worth 121 billion dollars, which is expected to increase to 150 billion dollars this year. China is a major player in international trade and commerce, hence both India and China will certainly avoid a war. Both the nations are nuclear powers and as such they are aware that a war will cause great harm to their economies. Besides, its industrial production will be adversely affected. Same situation will happen in India. Therefore, both the countries do not want war and are working through diplomatic negotiations and back channels to break the existing deadlock. Many rounds of talks have taken place between the two nations since the clashes in the Galvan Valley.  There is an effort between the India-China to start the peace process through the backdoor diplomacy. Dr. S. Jaishankar, External Affairs Minister, has been India’s Ambassador to China. Diplomatic relations between the People’s Republic of China and the Republic of India have become somewhat sour in past few years. Dr. Kavita A. Sharma, herself is an educationist, former principal of Hindu College, ex Director of The India International Center, New Delhi and has obtained a degree in LL.M. from British Columbia. Her well researched book; ‘India and China: Expansion, Equity and Excellence’, is publised by Springer Nature Singapore Pvt. Ltd. She has reviewed the historical developments of China till date. Post ‘Opium War’, Chinese rulers focused on education and empowered China economically through ‘Mandarins’.  Dr. Kavita A. Sharma, mentioned in detail about the 5000 years old culture of India-China relations, their history in which the youth has maximum importance and participation. For this reason, China educated its citizens to make them self-reliant, and today China is playing a leading role in political, economic globalization on its own.  In Chapter 10, the author says, “China has coordinated modernization, industry and technological development”. The Chinese socialist system is controlled by the State. It is infact a Communist country with State’s control. In India too, special attention has been drawn on technical self-reliance in the education sector. Digital technology has brought immense growth to world’s economies.  Padma Bhushan Mr. Shyam Saran, I.F.S. former Foreign Secretary of India has been quoted as saying, “the cultural and economic relations have existed since ancient times between India-China”. Buddhism spread from India to the land of China. Since ancient times, the people of China had chosen Indian universities, namely Nalanda University and Takshila University, to receive education in Buddhism because at that time these two universities were one of their kinds in the world as important centers of education. 1100 to 771 B.C. National Institutes of Education were established in China. Between 1840 and 1911, the traditional education policy was transformed into contemporary modernity.  On the one hand, special emphasis was laid on education in India, right from the Vedic period, while on the other hand, the historical characteristics were reflected in Indian culture. Along with China’s high-level education policy, in India also the private sector was established in the field of education, through the National Policy for Education, 1968, Kothari Commission, Ramamurthy Committee, National Knowledge Commission, Narayana Murthy Committee etc. gave several recommendations. Another important decision taken in China was the globalization of education, in which the State gave economic assistance to their citizens. Local people benefited from bringing foreign scholars into Chinese education system. The Indira Gandhi Open University was an important step in India, to extend education opportunities to Indians. The Ministry of Education and the University Grants Commission have played a special role in providing education till grass roots. In a World Bank report of 1988-89, it was said that development of the country is possible by incorporating education and culture to strengthen the economy.  In Chapter 9, Dr. Kavita A. Sharma has said that after the liberalization of the Indian economy, India established itself in the world rankings. In 1949, India established diplomatic relations with China. In this way India became one of the first countries to recognize the People’s Republic of China. The syllabus of the imperialistic British Empire is still being taught in India. Shyam Saran, vetran diplomat and author says, “the benefits of digitization and international cooperation that India has received are essential for the education of the masses”. China attacked India in 1962 and while occupying a lot of Indian land, and declared a unilateral ceasefire on 21 November 1962.  From that time till today relations between the two countries have not been trustworthy. After the death of Prime Minister Jawaharlal Nehru, Prime Minister Lal Bahadur Shastri extended the hand of friendship to China, but India did not get much success, because China had unjustly supported Pakistan in the India-Pakistan war of 1965. India-Pakistan ceasefire agreement was signed on 23 September 1965. In retrospect it may be stated that it is clear that the friendship between India and China, is prevalent since ancient times, has gone through many hurdles and unstable phases in the modern times.  The border dispute between India-China continues till date. Although there has been a huge improvement in the relations between the two, yet there are several unresolved issues in their relationship. A Day After Supreme Court’s Wrath: Prof. Neelam Mahajan Singh Suryavanshi SBI Submits Electoral Bonds Data To Election Commission Of India; A Day After Supreme Court’s Wrath: By Prof. Neelam Mahajan Singh Suryavanshi  The State Bank of India has submitted the Electoral Bonds data to the Election Commission of India today, after there was displeasure expressed by The Supreme Court.  The Supreme Court, on 11th March 2024, had rejected SBI’s plea, through their advocate Harish Salve, which was given no credence by the apex court. The Election Commission of India has put the above message on its X-Twitter handle. The Supreme Court came down heavily on SBI for “willful disobedience” of their order and warned it of contempt proceedings. This was in line with Supreme Court’s stern order to the national lender Election Commission will publish the data on its website by March 15, 2024. The State Bank of India (SBI) on Tuesday submitted the data of Electoral Bonds to the Election Commission of India (ECI), complying with the Supreme Court’s stern order issued on Monday, the poll panel said. The details of the sale and purchase of electoral bonds shared by the SBI are in a raw form that reveals who bought bonds worth how much and in favour of which political party. Thus all transactions have to be reflected on Election Commission of India website.  The data shared by the State Bank of India is being uploaded in a phased manner, with plans to release it all together on the evening of March 15, 2024. The Supreme Court of India’s bench, headed by Chief Justice Dr. Dhananjay Yashwant Chandrachud, Justice Sanjeev Khanna, Justice B. R. Gavai, Justice Manoj Mishra and Justice J. B. Pardiwala heard the plea of Sr. Advocate Prashant Bhushan of ADR. During 11th March, 2024 hearing, the State Bank of India argued that process of gathering, cross-verifying, and disclosing the data, stored in two separate “silos” for maintaining confidentiality on both ends, would be a time-consuming task. “We need a little more time to comply. We were told this is supposed to be a secret,” SBI said, seeking time till June 30, 2024 to submit all the details. In response the Supreme Court said, that donor details were accessible at the SBI’s Mumbai branch, and the bank only needed to “open covers, collate details, and provide information”. We had not directed the bank to match the details of donors and donee with other information. The SBI has to just open the sealed cover, collate the details and give the information to the Election Commission,” Chief Justice Chandrachud told the bank’s counsel. The introduction of electoral bonds aimed to replace cash donations to political parties, seeking to improve transparency in political funding. However, SBI had issued Electoral Bonds worth Rs. 16,518 crore in 30 tranches, since the inception of the scheme in 2018. The Supreme Court of India, in a landmark judgment on 15th February, 2024, held that the Electoral Bonds Scheme to be ‘unconstitutional and it violates citizens’ right to information’.
